HEDRICK HOUSE CONSTITUTION

ARTICLE ONE: MEMBERSHIP

-A “member” is anyone who has a valid contract with Hedrick House, Inc. A member is in good standing with the house if they are less than 30 days behind in their rent.

-No one may live in Hedrick House without signing a valid contract first, except temporary guests of members who abide by the Guest Policy as outlined in this document.

-Prospective members must be approved by current members by a unanimous house vote. This is to allow for any prospective denials to be approved in case of bad history, threats, stalking, etc between current house members and the prospective member.

ARTICLE TWO: RIGHTS AND RESPONSIBILITIES

Each member shall have one vote at Hedrick House meeting. There shall be no voting by proxy unless the house has given permission to a member for a certain situation.

  1. 1. Members are expected to:
    1. a. Understand and promote the aims and purposes of the cooperative.
    2. b. Take an active part in the affairs of the house.
    3. c. Exercise the power to vote.
    4. d. Perform all jobs and duties as required by the house.
    5. e. Be aware of the contents of the House Constitution.
  2. 2. Members are required to attend all house meetings. Members can be excused from house meetings if the house approves the reason for their absence. Members are allowed one unexcused absence and absences following the first will result in a $10 fine.
  3. 3. The membership has the right and responsibility to:
    1. a. Elect house officers
    2. b. Determine the use of the net surplus and savings
    3. c. Remove officers when they neglect to perform their duties properly
    4. d. Make changes in the affairs of the house.

ARTICLE THREE: DEPARTURES

New members' obligations consist of a $200 house loan, $60 house dues, and appropriate SHC dues, payable upon signing a contract with the house at SHC. Members who leave Hedrick House shall be refunded the entire house loan, minus any outstanding debts owed to the co-op by the member.

A member desiring to leave Hedrick House at any time during the terms of the members contract shall give prior notice of his or her intent to leave to the membership officer and must sign a release of contract from a reassignment. The leaving member is responsible for filling the vacancy that has been created. All debts incurred by the house in finding a replacement for the leaving member shall be charged to the member's accounts. The leaving member will be held liable for the room charged from the time the vacancy is created until a replacement is found, or until the end of the leaving member's contract, whichever comes first.

4. If two or more residents leave the house during or at the end of the same term and suitable replacements are not found by leaving residents individually, then all debts incurred by the house in replacements, including room charges, shall be divided between the two or more leaving members.

ARTICLE FOUR: MEMBER AGREEMENTS

All people must sign a contract with the SHC before establishing residency within the house.

Forty-five days prior to the end of the current term shall be the deadline for current members to sign a contract for the following fall term. If by this date a contract has not been signed, a place in the house cannot be guaranteed and the member loses all seniority within the house. Forty-five days prior to the end of the current term shall be the deadline for current members to sign a contract for the following summer term. If by this date a contract has not been signed, a place in the house cannot be guaranteed and the member loses all seniority within the house. If a summer term contract is broken by a current member, he or she shall forfeit $15 from his/her loan in addition to be liable for all room charged till the end of the contract.

ARTICLE FIVE: SENIORITY

Seniority in the house is determined by the number of terms a member has lived there, in that the higher the number of terms a member has there, the higher that member's seniority. In the case of new members, and in the case that two or more people have lived in the house the same amount of terms, seniority is then determined by the date a member signed a contract.

The seniority of a member who has left the house for two or more consecutive terms and then decides to return is established by placing the member at the bottom of that group which, at the time they move back, had been living in the house the same number of terms which the returning member had when she/he left.

ARTICLE SIX: ROOMS

Assignment of room form fall to spring shall be made on the basis of seniority at the end of every term prior to the time period in question. A member correctly assigned to a room shall have right of occupancy to that room until the end of the next spring term. Room sign-up for the summer term, which is subject to seniority, shall be arranged by the membership officer, Any two members of Hedrick House may trade their room assignments, with notice given to the membership officer.

ARTICLE SEVEN: KEYS

Every member is responsible for the two keys that belong to each room: one for the house and one for their room. If a member loses one of their keys they have to pay to have it replaced.

ARTICLE EIGHT: OFFICERS

Elections shall be held at the first house meeting of each term. Only members in good standing may be elected to an officer position. Officers are elected by a majority vote and may be removed from office by a two-thirds vote by members. TREASURER: The treasurer shall be elected from the beginning of fall term to the end of spring term. If the treasurer leaves at the end of fall term, a replacement will be elected and voted in. A treasurer for the summer term shall be elected. The duties of the treasurer are as follows: A. Submit a proposed budget for the term one week after the first house meeting. The budget is subject to amendment and approval by a majority vote of the members of the house. B. Maintain the house financial records in an accurate and timely manner. The financial records are to contain revenue and expense journals, revenue receipt book, deposit records, expense receipts for all purchases made by the house, and member accounts. C. Submit a budget variance for the previous term at the first meeting of each term. D. Pay bills for the house on time. E. Collect monies owed to the house. F. Keep the members informed of the status of their accounts and post rent lists in a public place in a timely manner. G. Record fines on member accounts as directed. H. Bring any member's large balance to the attention of the house. I. Represent Hedrick at SHC Finance meetings MAINTENANCE: The maintenance officer is elected for one term. The duties are: A. Initiate and implement a predictive and preventative maintenance program within the house. B. Submit a list of maintenance projects that are to be completed during the term at the second house meeting of the term and every meeting thereafter give a report as to the status of this list. C. Is responsible for preparing the house for any inspections. D. See that fire alarms and extinguishers are functional and fully recharged. A smoke detector inspection shall be done once a term. E. Represent Hedrick House at SHC Physical Development committee meetings. MEMBERSHIP: The membership officer is elected for one term. Duties include: A. Maintain the house at full capacity. This may require extensive correspondence with prospective members. The membership officer will arrange house tours and dinners for prospective members. It is suggested that the membership officer use the resources of SHC to aid the membership process. B. Coordinate room assignments. C. Be responsible for systematically distributing and labeling house keys and room keys to new members and gathering them from departing members. D. Orient new members as to the rules of the house within one week of their arrival. E. Maintain membership records on all current and last year's members. The membership officer is responsible for ensuring that a permanent record of all last year's members is kept at the SHC office. F. Maintain a file of forwarding addresses of members that have moved away. G. Coordinate Hedrick involvement in SHC ‘AMPOs. H. Represent Hedrick at SHC Membership Committee Meetings. EDUCATION: The education officer is elected for one term. Duties are: A. Submit or collect submissions for the SHC newsletter Pine Press. B. Educate house and community about SHC and Hedrick House. C. Maintain a revised copy of the house constitution. D. Assist Education Committee in coordinating MSU-SHC events. E. Represent Hedrick House at SHC Education Committee meetings.

ARTICLE NINE: HOUSE JOBS

B. Dinner Dishes -A member with dinner dish duty is responsible for after dinner clean-up one night per week. Two members can volunteer to work together per night. Dishes shall be completed before dawn. Dishes are to be washed in hot water with dish soap, rinsed with hot water, and then Finally, dishes should be set to dry in the open air on the dish rack. A person with dinner dish duty is also responsible for cleaning the counters, sweeping and mopping the kitchen, wiping the dinner table and putting away the dishes that have dried from earlier in the day. This job includes emptying kitchen trash and taking it to the dumpster. The kitchen must be swept and mopped nightly.

C. Lunch Dishes -A member with lunch dish duty is responsible for washing after lunch one day per week. Dishes shall be started after 1pm and finished before 4pm. Dishes are to be washed in hot water with dish soap, rinsed with hot water, and then sanitized in hot bleach water for at least seven seconds. Finally, dishes should be set to dry in the open air. A person with lunch dish duty is also responsible for cleaning the stove, microwave, toaster oven, counters, and dining table.

D. Outdoor Maintenance -Duties include: Cleaning walks of snow and salting steps. Mowing the lawn. Trimming trees and shrubs. Weeding flower beds and bike racks Picking up trash on the lawn, parking lot, and patio area.

E. Recycler -Duties include: Keeping recyclables and returnables in order. Maintain labels and information about what to recycle. Set out recyclables in time for curbside pickup. Take corrugated cardboard to the recycling center as needed.

F. Food Storage Organizing dry food/Pantry storage areas. Cleaning refrigerators and defrosting and cleaning the freezer Throwing away rotting food.

G. Basement Living Room Dusting and vacuuming once per week. Picking up trash and dirty dishes if they have accumulated. Cleaning the coffee table and tidying the entertainment center. Emptying trash receptacles properly.

H. Basement Recreational Area Dining room Sweeping and mopping the floor once per week. Wiping and cleaning off the dining table Picking up trash and emptying trash receptacles properly.

J. Plant Room Dusting and vacuuming once per week. Picking up trash and dirty dishes if they have accumulated. Watering plants as needed. Cleaning table and tidying shelves. Emptying trash receptacles properly. Mopping when necessary

K. Stairwells -Sweeping and mopping front, middle, and back stairwells weekly. L. Bathroom downstairs and upstairs -duties to be done weekly include: 1. Cleaning the sinks, mirrors, toilets and shower. 2. Washing the shower curtain and rugs. 3. Sweeping and mopping the floor. 4. Taking trash to the dumpster. 5. Refill soap dispensers 6. Empty recycling containers

M. Purchaser-The purchasers are responsible for purchasing food and supplies as needed by the house. Purchasers shall put away food and supplies. Hedrick house is responsible for providing the purchasers with a shopping list on the white board downstairs near the kitchen supply area. O. Mail Steward- Duties to be done daily include~ Bring mail in from the mailbox (Daily) Sort mail to respective housemates mailboxes Any mail sent to Hedrick addressed to a previous housemate will be forwarded to their new address Responsible for keeping mailroom tidy as well as keeping office supplies stored in the mailroom table in good supply by informing house shoppers. Done weekly.

P. Can Bitch- Duties to be done weekly include~ Empty aluminum cans container’s in: both in plant room, and under stairs by the back door. The cans are to be returned and the can deposits receipts given to the finance officer to be put towards house funds.

Q. Appliances- Duties to be done weekly include~ Clean kitchen appliances including but not limited to: Stove, blender, toaster, toaster oven, coffee maker, self clean oven once a month, etc.

R. Towels- Duties to be done weekly include~ Wash all towels that have been used in both upstairs and downstairs bathrooms, as well as the kitchen. Resupply towel locations above with fresh towels plus extras after cleaning Clean laundry room, empty lint garbage basket, and pick up trash

S. Hallways- Duties to be done weekly include~ Sweep and as often needed mop the upstairs and downstairs hallways

T. Stairs- Duties to be done weekly include~ Sweep and as often as needed mop the central and back stairs

U. Office labor-Duties to be done weekly include~ Going in to the SHC office and helping the office workers

V. Covid Crusher- Duties to be done daily include~ High-touch surfaces in common areas must be sanitized daily. Examples include tables, door knobs, light switches, countertops, handles, desks, faucets & sinks, toilets, touch screens. Keeps a log of guests in order to track social contact

ARTICLE TEN: FINANCES

Each member shall be assessed a proportional amount of house expenses each semester. The treasurer is to propose a revenue and expense budget for each term at the first house meeting of the term. Once a budget has been passed by membership, that budget shall be the guidelines for the spending policy. An existing budget may be amended by a majority vote at a house meeting. If there is a surplus at the end of the term, then each member's account is to be credited a proportional amount of that surplus. If there is a budget deficit at the end of the term, then each member's account will be charged a proportional amount of deficit. The house treasurer shall post a list of member account balances. The schedule of house charges shall coincide with SHC's assessment billing. The treasurer shall set the due date for rent three days prior to the due date for the assessment bill. The rent list will be posted by the treasurer seven days prior to the due date for rent. If a member owes the house more than 30 days rent, a promissory note shall be made with the member. The house treasurer is to follow the guidelines as stipulated in Title 6 of the MSU- SHC Code of Operations. If a member breaks any provision within the promissory note, he/she shall be assessed a $10 fine. If a member owes more than 45 days of rent, then the member's account is to be discussed at the next house meeting and a vote of confidence concerning the member is to be made.

FINE POLICY A. A member may have a fine charged to his/her account for the following reasons: Failure of a member to do or complete any one of his/her jobs. Unexcused absence from ICC or SHC meeting, if required within a member's house job description. Non-compliance with the house or SHC finance policy. Unexcused absence from house meetings.

B. It is suggested that the amount a member is charged for a fine is $5 which is amendable by the house. C. A written copy of the fine is to be given to the member and the treasurer. D. If a member is fined for failure to do or complete a house job, then the fine may be credited to any member who completes the job. E. Every member has the right to challenge any fine at the first house meeting following the issue of a fine. F. If a departing member fails to return all house keys distributed to him/her, he/she will be fined $20.

ARTICLE ELEVEN: EXPULSION

A. A member may be expelled from the house for any of the following reasons: Continual non-performance or poor performance of member's jobs. Nonpayment of money owed to Hedrick House. Malicious destruction of another member's property Or Hedrick house Property. Violation of housemate's rights. Use of force or threats of force, including sexual harassment, against house members or guests. Discrimination against any person because of race, gender, handicap, sexual preference, or national origin.

B. If the house wishes to expel a member, and then the accused member shall be personally notified in writing of the charges and shall be given a chance to respond at a house meeting before an expulsion vote is cast. C. A majority vote of all house members holding contracts is necessary to expel a member. This vote must be signed and petitioned listing all charges against a member. D. Upon passage of the motion to expel a member, the expelled member shall be given 24 hours to indicate when he/she will be leaving. If the person refuses to leave, the membership officer shall ask the SHC staff to initiate formal eviction proceedings in court. During the eviction proceedings, the rights of the expelled member shall be protected by house members. Expelled members may not be held responsible for the vacancy caused by expulsion. E. Non-renewal of contracts- A new member may be refused renewal of their house contract for any non-discriminatory reason, if a simple majority of the house membership agrees to such action.

ARTICLE TWELVE: HOUSE MEETINGS

A. House Meetings are called About every two weeks unless deemed necessary to be more frequent by the house. B. The first house meeting of the term should be held as soon as possible after all members have established residency, but no later than the first day of MSU classes. C. A quorum of the members of the house shall consist of two-thirds of the membership. A simple majority of members present at a meeting is required to pass motions. D. Attendance at house meetings is mandatory for all members. A $10 fine is charged to those with an unexcused absence.

ARTICLE THIRTEEN: GUEST POLICY

Guests are welcome at Hedrick, unless a majority of the members in the house feels uncomfortable by the presence of the guest. In this case a petition must be signed by the majority of the members in the house. If this happens, a house meeting must be called and, upon a majority vote, a member's guest privileges may be restricted. A guest may stay for a maximum of 5 days, after which a vote by the house is required to extend the guest's stay. Guests (not including touring guests) can not eat the house meal. A guest may be asked to contribute money and/or work hours.

ARTICLE FOURTEEN: PET POLICY

All plans for pets must be brought up at a house meeting before it is brought in the house. Any member bringing a pet into the house must submit themselves to a two week (Subject to extension) trial period in which other members of the house deem whether or not the pet will be a fair, clean, and unobtrusive addition to Hedrick house. There must be an alternate plan/place to stay for any pet brought into the house just in case it does not get approved after the trial period. Any and all pet allergies must be taken into account when bringing new pets into the house. Any pets brought into the house must be respected and cared for by their owners as well as housemates. Any case of animal mistreatment is a police matter and shall be treated as such. A three fourths majority vote of the house may allow the pet's entrance. Pet owners are responsible for any and all impact their animal has on the house’s day to day operations and environment. Including but not limited to sights, smells, animal droppings, use of house resources, and space needed to house the pet. Ex. Plant destruction No dogs as according the SCH policy In order to vote a pet out of the house, the members of the house must have a majority vote pro kicking the pet out in order to remove the animal.

ARTICLE FIFTEEN: AMENDMENTS

The House Constitution may be amended by a two-thirds majority of all members of Hedrick House in good standing. Notice of changes must be submitted to the SHC office with the signatures of the approving house members for computer revision.

ARTICLE SIXTEEN: CHECK OUT POLICY

Each departing member shall leave all house keys and forwarding address with the house membership officer. Each departing member shall be responsible for leaving his or her room clean and free of unnecessary debris for the next member.

ARTICLE SEVENTEEN: Friendship Clause

If any prospective member is friends with a current housemate who will be renewing their contract for the same year as the prospective member, the house holds the right to deny this potential member on the basis of the friendship clause. Additionally, if two or more prospective members are friends the house holds the right to approve membership to the the touree who contacted the membership officer first, and then deny the other potential members. Friendship is to be determined by the house and these situations will be voted on a case by case basis. This is to preserve the community style culture cultivated in Hedrick, and to prevent cliquing or “house take-overs”.

ARTICLE EIGHTEEN:COVID 19 RESPONSE

Guest Policy NO non-essential guests or visitors inside Hedrick house; Exceptions include SHC Maintenance Coordinator, SHC maintenance contractors, other SHC staff members and officers carrying out SHC business. Houses must be notified in advance when the aforementioned staff are visiting a house. Other Exceptions include close friends/significant others who submit to a temperature check and have been known to be in good health to the member who vouches for them to enter the house, ex. Has been self quarantining, hasn’t been at high risk gatherings of over 10 people, Wears a mask in public, etc. Temperatures over 100.4 will be asked to leave when checked. No community living guests, anyone from frats, sororities, and other co-ops are not allowed unless specifically given an exception. One guest at a time, only the same two guests. Covid crusher will make a log of guests. .

If a member violates the guest policy: ■ Violation #1 - House members discuss the guest policy with the member who violated it, make sure the policy is understood. ■ Violation #2 - A conflict resolution team made up of one fellow housemate and one member of the SHC COVID Response Team will meet with the member who violated the guest policy. They will discuss the importance of the guest policy and make the violating member aware of the consequences of violating the policy a third time. ■ Violation #3 - after a third violation the violating member could be found in breach of their contract, possibly causing their contract with the SHC to be terminated.

Communication and Notification Communications Point Person- The SHC COVID Response Team is asking all houses to appoint a one person for COVID̷ related communications̤ This is a safe person that everyone in the house can go to for reporting and guidance. Once appointed the communication point person will be added to a SHC̷ wide COVID̷ communication network made up of one member from each house. The purpose of The purpose of this network is to share resources among houses and to provide a space for houses to share updates on active COVID cases within the SHC. The COVID Communications point person is also responsible for completing the COVID 19 Reporting Form so that the COVID Response Team can actively monitor for any areas of concern. The COVID Communication Point Person will be responsible for: Sharing necessary safety updates with their house, Updating the COVID Response Team on the health status of their house, and alerting the Response Team if there is an active case in the house Sharing resources with house members, such as the location of COVID testing sites. If there is an active case in the house, putting quarantine measures into place.

House sanitation and Safety practices Creation of the “Covid Crusher” Job as a catch all for surfaces in the house needing sanitization regularly. Sanitation & Cleaning ● Continue normal routine cleaning with soap and water in all common areas; In addition, high-touch surfaces in common areas must be sanitized daily. Examples include tables, door knobs, light switches, countertops, handles, desks, faucets & sinks, toilets, touch screens. Masks & Social Distancing ● Face masks are to be worn on all trips outside of the house. High-Risk Events / Venturing Outside the Home ● NO housemate is to engage in high-risk events outside of the home; Exceptions include essential workers and students with in-person classes. ○ High-risk events include house parties, going to bars or clubs, gatherings of more than 10 people in a confined, unventilated space. ● Housemates should limit use of city buses until it is deemed doing so will not put individuals at risk.

Quarantine ● Members should regularly monitor themselves for COVID-19 related symptoms (persistent cough, elevated temperature, difficulty breathing, rash, cold, diarrhea and/or vomiting) and follow uniform safety practices. ● If a member is ill, they are required to self-quarantine and self-monitor; testing for COVID-19 is recommended. ○ If negative, member should remain self-quarantine until: ■ They have been fever free without medication for at least 72 hours ■ All other symptoms have improved ■ 10 days have passed since symptoms first appeared ■ Received two negative COVID-19 tests in a row, 24 hours apart. ○ If a positive test for COVID-19, a member must self-quarantine until: ■ They have been fever free without medication for at least 72 hours ■ Quarantined for 14 days ■ All other symptoms have improved ■ Have two negative COVID-19 tests completed in a row, 24 hours apart ■ Have documentation from a physician that it is safe for them to return to a shared congregate living environment. Adoption and Enforcement If a member violates the Sanitation and Safety Policy: ■ Violation #1 - House members discuss the Sanitation and Safety Policy with the member who violated it, make sure the policy is understood. ■ Violation #2 - A conflict resolution team made up of one fellow housemate and one member of the COVID Response Team will meet with the member who violated the Sanitation and Safety Policy. They will discuss the importance of the Sanitation and Safety Policy and make the violating member aware of the consequences of violating the policy a third time. ■ Violation #3 - after a third violation the violating member could be found in breach of their contract, possibly causing their contract with the SHC to be terminated.

ARTICLE 19: PERSONS AND PROPERTY CONSENT

Consent: The voluntary, willful, and unambiguous agreement to engage in a specific activity during a specific encounter. Consent cannot be given by someone who is under the influence, being coerced, mentally incapable or incapacitated for any reason. Persons must have permission before entering another housemates room or using their belongings Don’t touch persons bodies without consent Be respectful of other people's belongings including breaking property etc. Ask for consent before venting or unloading on another person in conversation. Emotional baggage or triggers must be consented upon before bringing up in conversation.
